Terms of use
The short version. Klubbit is an app that helps clubs run their club: events, chat, members, memberships and payments. You must be 18 or over to use it. Clubs are run by their own organisers, who set their own rules and prices, and payments go to the club, not to Klubbit. Be decent to people (see our Community guidelines), and you can delete your account at any time.
This summary is for convenience. The full terms below are what apply.
1. About these terms
These terms are an agreement between you and Klubbit Ltd, a company registered in England and Wales (company number 17554598), whose registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("Klubbit", "we", "us"). They apply whenever you use the Klubbit app or website.
By creating an account or using Klubbit, you agree to these terms and to our Community guidelines. Our Privacy policy explains how we use your personal information.
2. Who can use Klubbit
- You must be 18 or over. We ask you to confirm this when you sign up. If we find that an account belongs to someone under 18, we will close it.
- You must give accurate information about yourself and not pretend to be someone else.
- You can't use Klubbit if we have previously suspended or removed your account, unless we've agreed otherwise.
3. Your account
- Keep your sign-in details secure and don't share your account. You're responsible for what happens on your account.
- Tell us straight away at support@klubbit.co.uk if you think someone else has accessed it.
- We may send you service messages, such as sign-in emails, payment confirmations and important changes. You can choose which other notifications you get in the app's settings.
4. Clubs and organisers
Anyone 18 or over can create a club on Klubbit. The person who creates a club, and anyone they make an admin or give permissions to, are its organisers.
- Clubs are run by their organisers, not by Klubbit. Organisers decide who can join, the club's rules, events, prices and membership terms. Klubbit provides the tools; we aren't responsible for how a club is run, for its events or activities, or for disputes between members and their club.
- Taking part in activities is at your own risk. Klubbit doesn't organise, supervise or insure club events. Check the club's own arrangements, such as insurance, safety and governing body membership, with the club.
- Organisers must use Klubbit lawfully, describe their club and charges honestly, only use members' information for running the club, and act on reports in their club fairly and promptly.
- An organiser who owns a club must hand over ownership or delete the club before deleting their own account.
5. Memberships and payments
Clubs can collect membership fees and event payments in Klubbit. Payments are processed by our payment provider, Stripe.
- When you pay a club, you're paying the club. Your money goes to the club's own Stripe account. The club, not Klubbit, is the seller, and is responsible for what it provides in return.
- Fees. Klubbit charges a small service fee on payments made through the app, and Stripe charges its own processing fees. The club chooses whether it or its members pay these fees, and you'll see the amount before you pay. Payments a club marks as paid in cash carry no Klubbit fee.
- Membership terms are set by the club. That includes prices, membership types, season or rolling periods, instalments, renewals, any trial period, and any grace period before an unpaid membership ends. If a membership isn't paid by the end of its grace period, the club may remove you; you can rejoin later.
- Saved cards and Direct Debits. If you set up recurring payments, you authorise the club, through Stripe, to take the agreed payments until you cancel or your membership ends. We'll remind you before scheduled payments where the app supports it.
- Refunds are up to the club. Contact the club's organisers first. Your legal rights as a consumer are not affected. If you have a problem with a payment you can't resolve with the club, contact us and we'll try to help.
- Clubs that collect payments must also accept Stripe's terms for connected accounts, and are responsible for their own tax, accounts and refunds.
6. Your content
- You own what you post, such as messages, photos and event details ("your content").
- You give Klubbit permission to store, display and share your content within the app, as needed to run and improve the service. For example, showing your messages to your club's members, or photos in your club's gallery. This permission ends when your content is deleted, except where it has been shared with others and they still need it (for example, messages in a club chat).
- Only post content you have the right to share, and get people's agreement before posting photos of them.
- When you leave a club or delete your account, some content stays with the club, such as your messages in club chats (shown as from a "Deleted user" if you delete your account) and photos the club has accepted into its gallery. See Delete your account for the details.
7. Acceptable use
Follow our Community guidelines. In particular, you must not:
- harass, bully, threaten or abuse anyone, or post hateful, sexual or illegal content;
- share other people's personal information without their permission;
- use Klubbit for spam, scams, or advertising that a club hasn't agreed to;
- collect payments dishonestly or for anything illegal;
- try to break, overload, reverse-engineer or get unauthorised access to Klubbit or other people's accounts; or
- use automated tools to scrape or copy data from Klubbit.
8. Reports, moderation and suspension
- You can report messages, photos, people and clubs in the app, and block people. Reports in a club go to its organisers; we can also review reports.
- Club content may be hidden automatically when several different members report it, until someone reviews it.
- We may remove content, hide a club from Explore, reset a club's details, or suspend an account if we reasonably believe these terms or our Community guidelines have been broken, or to protect people or comply with the law. Where it's safe and practical, we'll tell you what we've done and why.
- A suspended account can't sign in or be used to create a new account with the same email. If you think we've made a mistake, email support@klubbit.co.uk and we'll look again.
9. The service
- Klubbit is currently in beta. Features may change, and things may occasionally not work as they should. We'll try to give notice of important changes.
- We work hard to keep Klubbit available and secure, but we can't promise it will always be uninterrupted or error-free.
- Some features rely on other services, such as maps, app stores, sign-in providers and Stripe. Their own terms may also apply.
- The Klubbit name, logo, app and website belong to Klubbit Ltd. You may not copy or reuse them without our permission.
10. Ending your account
- You can delete your account at any time in the app (Profile → Account → Delete account) or by following the steps on our Delete your account page.
- We may close or suspend your account under section 8, or if we stop providing Klubbit. If we close Klubbit altogether, we'll give you reasonable notice where we can.
11. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law. Your legal rights as a consumer are not affected.
- We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We aren't responsible for loss that wasn't foreseeable, for business losses, or for the acts of clubs, organisers or other members.
- Members don't pay Klubbit to use the app, other than any fee shown when paying a club. If you're an organiser using Klubbit for a club, our total liability to you for anything related to Klubbit in any 12 months is limited to the fees Klubbit received from your club in that period, or £100 if that's higher.
12. Changes to these terms
We may update these terms as Klubbit develops. If a change is significant, we'll tell you in the app or by email before it takes effect. If you don't agree with the new terms, you can delete your account; if you keep using Klubbit after they take effect, the new terms apply.
13. Law and disputes
These terms are governed by the law of England and Wales. If you have a complaint, please contact us first and we'll try to resolve it. If we can't, you can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
